Need Clarification?

Clarification questions regarding the Moot Problem must be submitted to the Committee in writing by January 19, 2024. Requests for clarification received after the deadline shall not be accepted, except at the discretion of the Committee. Requests must include a brief explanation as to why each clarification is necessary.

Requests will be answered at the discretion of the Committee. Questions cannot relate to the substantive legal issues (or sub-issues) raised by the Moot Problem. Requests should be clear and only in relation to the interpretation of these Rules, procedural matters or the facts contained in the Moot Problem.

1. Which parties are the appellants and respondents for the purposes of the Moot?

Kingsland Inc., Dragonrider Pictures and Tallturret Studios, together, are the appellants. The Commissioner is the respondent. As stated in the Respondent’s Factum section of the Rules, Respondents may cross-appeal at their discretion and all argument related to the cross-appeal shall be dealt with during the oral phase of the Competition.

2. Can the Respondents’ factum include arguments related to a cross-appeal, or must all arguments related to a cross-appeal be raised only at the oral argument phase of the Competition?

Respondents may include arguments related to a cross-appeal in their Factum if they so choose. These arguments will be dealt with during the oral phase of the Competition to the extent that Mooters raise them for consideration by their Oral Judging Panels. Mooters should keep in mind that, according to the Rules, the scope of a Mooter’s oral argument must relate to the written submissions found in their factum.

3. Does the phrase "number of films shown" (paragraph 27 of the Official Problem) refer to the number of specific movie titles available at independent theatres or the number of total showtimes for all movies shown at independent theatres?

The phrase refers to the number of specific movie titles shown at independent theatres, not the total number of showtimes.

4. Having regard to the correction made to the language in paragraph 11 of the Official Problem, is it intentional that paragraphs 34 and 64 were left as "below 10%" and "less than 10%" respectively?

Yes, the language in paragraphs 34 and 64 is intentionally drafted as such.
